Guidance Navigation successfully enforces Judgement against former employee

In January 2014, Guidance won a case in the High Court against its former Marine Sales Manager for wrongfully taking and using intellectual property. The High Court success was the final chapter in Guidance’s legal action against two key managers, Dennis Farrell and senior design engineer Dr Dominic Pearce, in February 2012, when it became aware that they were using its intellectual property to set up a competitor company. The managing director of Guidance discovered at that time that they had been taking confidential information and intellectual knowledge from the award-winning firm to set up a rival company from as far back as 2009. Five defendants were served with High Court injunctions after setting up a company called ARBS, fronted by two personal friends of Farrell and Pearce as the two men syphoned off material and customer leads through their employment with Guidance. Guidance then successfully pursued a claim against all five parties, four of whom including Pearce settled out of court on terms favourable to Guidance. However, Dennis Farrell opted to take his case for a trial hearing by judge at the High Court, which Guidance resoundingly won.
